The IRS has released 2009 Cost of Living Adjustments for Transportation Benefits
For 2009, the monthly limit on the amount that may be excluded from an employees income will be $230 for qualified parking benefits and $230 for qualifed transit expenses.

Mileage Rate for Medical Transportation
The 2009 FSA Mileage Rate for Medical Transportation will be a 24-cent standard mileage rate for use of an automobile to obtain medical care for 2009.

EBPA FSA Benefit Card Holder News

EBPA has been made aware of a data breach involving Heartland Payment Systems during the period of 5/15/2008 and 11/13/2008.

Heartland Payment Systems processes transactions on behalf of businesses nationwide. Debit and credit cards, including EBPA Benefits Cards, used for payment and processed through Heartland Payment Systems during this time period may have been compromised. Please note that according to Heartland Payment Systems, no cardholder social security numbers, addresses, or telephone numbers were involved in the data breach. If a participants EBPA Benefits Card is identified as potentially being compromised, we will notify the participant, deactivate their card, and reissue a new card.


The IRS has issued a transitional relief extension on the implementation of Notice 2007-2.

IRS TRANSITION RELIEF EXTENSION The notice in Internal Revenue Bulletin Number 2007-2 restricts the types of merchants where the EBPA Benefits Card can be used. On January 1, 2008, non-healthcare merchants were required to have an Inventory Information Approval System (IIAS) in place in order for healthcare benefits cards to be used at their locations. An IIAS allows a merchant to identify which purchase items qualify as eligible healthcare expenses, as defined by the Internal Revenue Code. Beginning January 1, 2009, the notice in Internal Revenue Bulletin 2007-2, required that pharmacy merchants also support an IIAS in order to accept the EBPA Benefits Card. The deadline in Notice 2007-2 has been extended by six months so that, after June 30, 2009, health FSA and HRA debit cards may not be used at stores with the Drug Store and Pharmacy merchant category code unless the requirements of an IIAS, or 90% rule (further defined by the official IRS notice) are met.
